Our service is delivered in tiered packages as detailed on our website. We are not a marketing agency in the traditional sense; we provide a technology-driven, managed system. We do not perform direct sales calls or close deals on behalf of the client.

3. Client Responsibilities and Compliance

You are solely responsible for all outreach activities conducted using the Leads or ad campaigns we provide. You agree to comply with all applicable local, state, national, and international laws and regulations, including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and GDPR/CCPA. This includes honoring opt-out requests and maintaining a "Do Not Call" list. You agree to indemnify and hold harmless Nexus AI Leads from any claims arising from your outreach practices.

4. Payment and Subscription Terms

  • Billing: All payments are processed securely by our merchant of record, Paddle.com. By subscribing, you authorize Paddle to charge your chosen payment method on a recurring monthly basis.
  • Term: The subscription renews automatically each month until you cancel.
  • Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period, and you will not receive a refund for the current month.
  • Ad Spend: For plans including ad management, the client is responsible for their own advertising budget, which is paid directly to the ad platform (e.g., Google). Our fee is for management services only.

5. Intellectual Property

We retain all ownership rights to our system, technology, processes, and the Leads until payment is successfully processed. Upon full payment, you are granted a non-exclusive license to use the provided Leads for your business outreach.

6. Disclaimers and Warranties

Nexus AI Leads makes no guarantees regarding the Client's ability to convert Leads into sales. A Lead's conversion is dependent on numerous factors outside of our control, including but not limited to the Client's sales process, response time, and market conditions. Our sole contractual obligation is to deliver Leads and services that meet the quality and quantity metrics as defined in our publicly posted "Our Methodology" document.

7. Limitation of Liability

Our total liability to you for any cause of action whatsoever will at all times be limited to the amount paid, if any, by you to us for the Service during the month in which the claim arose.

Due to the digital nature of our services and the immediate access you receive to proprietary data and systems, all subscriptions to Nexus AI Leads are non-refundable. When a subscription is purchased, the client is paying for access to the service for the entirety of the current billing period (e.g., one month). We do not provide pro-rated refunds for partial months of service.

2. Service Guarantee and Lead Replacements

Our confidence in the quality of our service is paramount. Instead of a cash refund, we stand by the quality of our work with a performance guarantee. If any Lead we provide fails to meet the quality criteria outlined in our publicly posted "Our Methodology" document (e.g., email deliverability below 95%), we will provide a replacement lead of equal or greater value free of charge.

To request a replacement, you must contact our support team at support@nexusaileads.com within 7 days of receiving the Lead list. We will review all requests and process valid replacements within a reasonable timeframe.

3. Cancellation Policy

You may cancel your subscription at any time to prevent future recurring charges. Cancellation must be processed through your Paddle account or by contacting our support team. All cancellations will take effect at the end of the current billing period, and you will not receive a refund for the current month. You will continue to have access to the service until the end of the period you have already paid for.

4. Billing Errors

If you believe that you have been charged in error, please contact us at support@nexusaileads.com within 30 days of the charge. We will investigate the issue and, if we find an error was made on our part, we will issue a full refund for the incorrect charge.

We do not sell stale, pre-packaged lists. Our leads are sourced, enriched, and verified on-demand for each client to ensure maximum quality and relevance.

  • Step 1: Signal Sourcing (Apollo.io): We use industry-leading data platforms to identify potential contacts within your specific niche (e.g., roofing, HVAC) and target geographic area.
  • Step 2: AI Enrichment (Clay.com): This is our core value. We do not just provide a name and email. We use AI models to cross-reference multiple public data points to find "intent signals." This process analyzes data to answer questions like: Is this business actively hiring new technicians? Did they recently receive new funding?
  • Step 3: Deliverability Verification (NeverBounce): Before any list is delivered, it is automatically processed by a third-party verification service. This step is designed to purge invalid, stale, or non-deliverable email addresses.

3. Our Service Level Guarantee

This is our core promise and serves as the basis for our Refund Policy.

  • Service Guarantee: We guarantee that at least 95% of the email addresses in any lead list we deliver will be "Valid" or "Deliverable" as confirmed by our third-party verification service.
  • Your Remedy: If a delivered list fails to meet this 95% deliverability standard, you are entitled to a free replacement for any "bad" leads (e.g., if we deliver 100 leads and 10 are invalid, you will receive 10 new, verified leads at no charge).
  • How to Claim: To request a replacement, you must contact support@nexusaileads.com within seven (7) days of receiving the lead list.

Critical Exclusion: This guarantee applies only to email deliverability. We do not and cannot guarantee a lead's willingness to respond, their interest in your service, or your ability to convert that lead into a sale. Our contractual obligation is to deliver a valid, enriched, and deliverable contact.

4. The Ad Management Process (Growth & Scale Plans)

Our ad management service is designed to be fully "done-for-you" and 100% asynchronous.

Platform: We specialize exclusively in Google Local Services (LSA) Ads. This platform is designed for high-intent, "in-market" customers and provides the most direct path to qualified calls and booked jobs.

Our Asynchronous Process:

  • Onboarding: Upon subscribing, you will complete our automated onboarding form (via Tally.so). This form securely collects your Google Business Profile access, target locations, service types, and budget. This form replaces all traditional kickoff calls.
  • Management: Our certified ad partners will build, launch, and manage your LSA campaigns. This includes optimizing bids, disputing unqualified leads with Google, and managing your profile.
  • Reporting: You will receive a comprehensive, easy-to-understand PDF performance report via email each month. This report replaces all traditional monthly strategy calls.

Client Responsibility: You are responsible for paying all ad spend costs directly to Google. Our subscription fee is for management, optimization, and reporting services only.

  • Delivery: All lead lists are delivered to you via a secure, expiring Google Drive link sent to your email.
  • Security: We do not store your payment information, which is handled exclusively by our Merchant of Record, Paddle.com. All client data is handled in accordance with our Privacy Policy.

3. Our Proven Process: From Setup to Scale

  • Phase 3: Optimization & Management (Ongoing): Our team continuously monitors and optimizes your campaign performance. We manage bids, dispute bad leads, and ensure your profile is fully optimized.

4. What's Included in Our Management Fee

6. Terms & Conditions for Ad Management

Client Responsibilities: You agree to provide timely access to Google accounts, ensure your budget is funded, and follow up on leads promptly.

Payment: The ad management service is billed in advance along with your lead generation subscription. The fee is non-refundable for the current month once the campaign has commenced.

Term and Cancellation: The ad management service is a month-to-month subscription that runs concurrently with your lead generation plan. You may cancel your subscription at any time. Cancellation must be processed through your Paddle account or by contacting our support team. The cancellation will take effect at the end of your current billing period.

Limitation of Liability: Nexus AI Leads and our ad partners will not be liable for any lost profits or consequential damages arising from your business decisions or market conditions. Our total liability to you shall not exceed the total management fee you have paid us for the service.

Governing Law: These terms shall be governed by the laws of the State of Delaware, United States.
